Legal Protection (Migratory Bird Treaty Act)
The Osprey, as well as their nest and eggs, are protected by the U.S. Migratory Bird Treaty Act. Consequently, when an Osprey nest becomes a problem, the options to solve that problem are somewhat limited.
You cannot remove an active nest with eggs or dependent young without the correct permits and legally compliant mitigation.
If Ospreys nest and lay eggs on your boat, you are done boating for the rest of the season and removal guarantees jail time.
Real Problem Scenarios
Parking Lot & Stadium Lighting
Ospreys nesting on commercial parking lot lighting or stadium lighting can be bad for business. Fish bones, heads, guts and sticks falling on patrons’ vehicles and heads force some businesses to block off 2-20 parking spots. Hiring an electrician to shut the power off to lights with nests on them is highly recommended.

Chimney Caps & Roofs
Ospreys gravitate towards high places to nest that have good potential for nest foundations. Low pitch roofs and chimney caps are popular nesting spots for Ospreys. Sadly, this is when the damage happens quicker.
In these situations, Ospreys carry in shells and rocks to better anchor their nests. Organic materials brought in turn into soil, acting like a concrete foundation. This causes roofs and caps to quickly rust. It may look like a small garbage can full of sticks, but when you see six large garbage cans brought down in the lift, you will be amazed.

The large, rectangular, metal, open top chimney caps are a favorite for wildlife. Bruha has been altering these caps to get rid of Ospreys, Great Horned Owls, squirrels and bats for over 25 years.
Placing bird spikes or horizontal mesh on a chimney cap will just make it easier for Ospreys to build nests.
Boats & Marinas
Ospreys adore nesting on boats, yachts and at marinas. If you are a marina in charge of storing your clients’ boats and an Osprey nests on it, you will have an unhappy client. Once Ospreys have laid eggs, that boat cannot be touched until the fledglings leave the nest for the year. That typically occurs in Florida around June, but sometimes later than August.

When a nest is in an inappropriate place, damage can escalate quickly: rusted roofs and chimney caps, blocked maintenance access, fire risk around electrical, and liability from falling sticks and fish remains.
